California Court of Appeal

People v. Delarosarauda, B248615

Defendant's conviction and sentence for corporal injury to a co-habitant, assault, and misdemeanor vandalism is: 1) vacated in part and remanded, where the trial court lacked authority to issue that portion of the protective order barring defendant from having contact with his son and stepdaughter, as they were not "victims" within the meaning of Penal Code sections 136.2(i)(1) and 273.5(j), nor was the postconviction protective order authorized under section 136.2(a)(6); but 2) otherwise affirmed.
