Staub v. Kiley, C071500

Judgment entered in favor of defendants in plaintiffs' action for medical malpractice following defendants' motion for nonsuit is reversed and remanded, where: 1) defendants lacked standing to move to exclude plaintiffs' experts from testifying at trial because defendants themselves failed to make a complete and timely compliance with the exchange procedures of Code of Civil Procedure section 2034.260; and 2) the trial court erred in concluding plaintiffs so unreasonably failed to comply with the expert disclosure demand that their experts could be properly excluded from testifying.
