California Court of Appeal
Kim v. Konad USA Distribution, G048443
The trial court's award to plaintiff of $60,000 against defendant-former employer and defendant-former boss, on her claims of sexual harassment and wrongful termination is affirmed, where: 1) plaintiff did exhaust her administrative remedies; 2) defendant's claim that it had less than five employees fails because all employers (not just those with five or more employees) accused of sex harassment are subject to a FEHA harassment claim, and a wrongful termination against public policy common law tort based on sexual harassment can be brought against an employer of any size; and 3) defendant-former boss does not establish how any error in finding him liable for wrongful termination in violation of public policy was prejudicial where the court found both defendants liable on all causes of action and does not differentiate between the defendants in the award of damages.
