Dismissal of plaintiff's complaint, which alleges multiple causes of action including constructive eviction and retaliatory eviction, is reversed and remanded, where the trial court erred in concluding that: 1) plaintiff's residential lease was void and that he was a squatter with no legal rights because a code enforcement notice (red tag) terminated his original tenancy with the prior owner; and 2) any subsequent lease with defendant was an illegal contract and void.
