California Court of Appeal

Disenhouse v. Peevey, D063799

A person desiring to commence an action against the Public Utilities Commission (PUC) may only do so by filing a petition for writ of mandate in the Supreme Court or the Court of Appeal and may not do so by filing an action for injunctive relief in the superior court. Accordingly, the superior court did not err by dismissing plaintiff's complaint against the PUC for lack of subject manner jurisdiction, and plaintiff's injunction application is now moot.
