People v. Rose, A135974

Defendant's convictions for resisting an executive officer and misdemeanor assault on a peace officer, arising out of his hitting an officer with a folding chair during an Occupy Oakland vigil, is conditionally reversed and remanded for further Pitchess proceedings involving one officer for the limited purpose of reviewing the declaration of the police custodian of records, but the trial court's denial of defendant's Pitchess motion as to the remaining officers was harmless.
