Graham v. Bank of America, D063779

Dismissal of plaintiff's complaint for fraud and deceit, violations of Business and Professions Code section 172002, and declaratory relief, arising out of defendant's allegedly improper mortgage banking practices, is affirmed, where: 1) the trial court correctly determined plaintiff does not allege actionable fraud, reasonable reliance on defendants' alleged opinions or predictions, or causation; 2) plaintiff does not state a cause of action for violation of the California Unfair Competition Law; 3) plaintiff is not entitled to declaratory relief; and 4) the trial court did not abuse its discretion in denying leave to amend.
