In a negligence action arising out of a collision between the plaintiffs' vehicle and defendant's truck, where the jury returned a verdict finding defendant negligent but that his negligence was not a substantial factor in causing harm to plaintiffs, the trial court's denial of plaintiffs' motion for a new trial is reversed, where: 1) the special verdict is neither inconsistent nor unsupported by substantial evidence; but 2) the trial court's findings show that its denial of plaintiffs' motion for a new trial rested on an error of law.
