Gloster v. Sonic Automotive, Inc., A137081

In an employment related action, the trial court's denial of defendant-employer's motion for summary judgment and petition to compel arbitration are: 1) dismissed in part, where the denial of the summary judgment motion is not appealable; but 2) reversed in part, with regard to the denial of the petition to compel arbitration, where Code of Civil Procedure section 1281.2(c) is inapplicable to the agreements executed by plaintiff, and plaintiff failed to carry his heavy burden of demonstrating that defendant's delay in petitioning to compel arbitration was unreasonable and prejudicial.
