California Court of Appeal

People v. Jandres, H039079

Defendant's convictions of forcible rape with a kidnapping enhancement, kidnapping to commit rape, and felony false imprisonment are reversed and remanded for retrial, where: 1) the trial court erred by admitting evidence of uncharged acts and by not adequately instructing the jury in various regards; 2) the cumulative effect of the court's errors was prejudicial to defendant, requiring reversal; and 3) the false imprisonment conviction must also be vacated for the additional reason that defendant cannot be convicted of both kidnapping for rape and its lesser included offense of felony false imprisonment.
