California Court of Appeal

People v. Acosta, G049326

Defendants' convictions and sentences for violating Penal Code section 502.5 by taking improvements or fixtures from their foreclosed home are affirmed but modified, where: 1) section 502.5 is not unconstitutionally vague; 2) the trial court did not err in instructing the jury on the term "fixture" or on the great taking enhancement; but 3) defendants should be ordered to pay probation supervision costs in a separate order, rather than as a condition of probation.
