California Court of Appeal
People v. Gonzalez, G047199
Defendant-juvenile's sentence of 50 years to life for first degree murder and street terrorism, with gang penalty and firearm enhancements is affirmed, where: 1) defendant does not face a life without the possibility of parole sentence because new legislation effective January 1, 2014, provides for a parole hearing for juvenile offenders like defendant in the 25th year of their incarceration, usually within their life expectancy by a matter of decades and therefore well within constitutional norms; and 2) there is no merit in defendant's as-applied, disproportional punishment challenge or his ineffective assistance of counsel claim.
