California Court of Appeal
Mega RV Corporation v. HWH Corporation, G047718
In an action in which defendant-RV retail seller seeks indemnity for its costs in defending a lawsuit under the Song-Beverly Consumer Warranty Act, from a component parts manufacturer of the RV, the trial court's judgment in favor of the component parts manufacturer is: 1) affirmed in part, where defendant is not entitled to indemnity because a component parts manufacturer is only subject to obligations under the Song-Beverly Consumer Warranty Act if it has provided an express warranty to the consumer pertaining to the component part at issue; but 2) reversed in part, where the trial court erred in applying the tort of another doctrine, so the award of attorney fees as damages to the component part manufacturer is stricken.
