The trial court's order compelling binding arbitration of plaintiff-former employee's claims of constructive discharge in violation of public policy and in breach of express or implied employment contracts, and the order confirming the arbitration award dismissing his claim, are vacated and remanded with instructions to dismiss the matter for lack of subject matter jurisdiction, where plaintiff's failure to timely comply with the mandatory administrative exhaustion requirements of Financial Institutions Reform, Recovery and Enforcement Act of 1989created a jurisdictional bar to his claims.
