NBC Universal v. Superior Court (Montz), B250892

In an action in which plaintiffs allege breach of implied contract, and breach of confidence arising out of defendants' development of the "Ghost Hunters" television show which plaintiffs claim was a misappropriation of their idea, the trial court erred in denying defendants' motion for summary judgment, where: 1) defendants made a prima facie showing that plaintiffs' causes of action were time-barred as a matter of law; and 2) plaintiffs did not demonstrate their entitlement to delayed accrual of their causes of action under the discovery rule.
