Defendant's conviction at his second trial for second degree murder is affirmed, where: 1) the prosecutor's arguments did not violate collateral estoppel principles because defendant's acquittal at the first trial on the first degree murder charge was not a factual finding that he acted without planning or premeditation; and 2) the trial court did not err in its jury instructions.
