California Tow Truck Assn. v. City and County of San Francisco, A135960

In a challenge to defendant-city's tow truck regulatory scheme, judgment for defendant-city is reversed and remanded, where: 1) defendant-city is authorized to regulate only those tow truck companies and drivers who maintain their principal place of business or employment in that city; 2) defendant-city's attempt to regulate towing services and drivers whose principal place of business or employment is located in another jurisdiction is preempted by state law; and 3) defendant-city may collect a fee or fees to cover the cost of that regulation.
