In the People's challenge to sentencing imposed under the Criminal Justice Realignment Act of 2011 in multiple cases for petty theft, possession of and under the influence of methamphetamine, possession of and under the influence of methamphetamine, the trial court's finding that defendant was eligible under the Realignment Act to serve his state prison sentence locally is reversed and remanded for resentencing, where: 1) defendant is not qualified to serve his sentence locally because he is required to register as a sex offender; and therefore, 2) defendant is required to serve his sentence in state prison.
