Bock v. Hansen, A136567

Dismissal of plaintiff-insureds' claims against defendant-insurance adjuster for negligent misrepresentation and intentional infliction of emotional distress arising out of his alleged misconduct in the handling of their property damage claim is reversed and remanded, where: 1) negligent misrepresentation can be asserted against an insurance adjuster, and such claim was adequately pleaded here; and 2) intentional infliction of emotion distress can lie against an insurance adjuster, and here, although the intentional infliction of emotional distress claim was not adequately pleaded, the trial court abused its discretion in denying leave to amend.
