A writ of mandate to overturn the trial court's denial of defendant's pretrial motion to set aside great bodily injury (GBI) enhancement allegations in his drunk driving trial is granted, where: 1) defendant is charged with vehicular manslaughter; and 2) the enhancements must be stricken under the GBI statute's plain terms providing that the section shall not apply to murder or manslaughter.
