People v. Dubose, E054926

Defendant-minor Dubose's convictions and life without parole sentence for first degree murder, carjacking, robbery, kidnapping for purposes of committing robbery, and fleeing a pursuing peace officer, with special circumstances findings are: 1) reversed in part and remanded for resentencing, where the trial court erred in sentencing him because it was unaware it had the authority to sentence him to a prison term of 25 years to life; and 2) otherwise affirmed. Defendant-minor Whitmore's convictions and sentence for first-degree murder, carjacking, robbery, and kidnapping for purposes of committing robbery are: 1) reversed in part and remanded for resentencing, where it is unclear what felony constitutes the underlying felony for the felony murder; but 2) otherwise affirmed.
