A petition for a writ of mandate filed by petitioner-prisoner, who has been sentenced to death, seeking various records from the District Attorney's Office of San Diego County under the California Public Records Act (CPRA) to assist in investigating whether the District Attorney impermissibly sought the death penalty based on the race of the defendant, the victim, or both, is granted, where the District Attorney's copies of judicial documents, which must be made available to the public upon request at the superior court, are not entitled to exemption from disclosure as investigatory documents under the CPRA and would not violate the privacy rights of either the defendants or victims in homicide cases.
