In an action between two beneficiaries of a trust, in which plaintiff alleges financial elder abuse and claims that a 2011 amendment favoring defendant was invalid due to defendant's undue influence and the mother-trustor's lack of testamentary capacity, the trial court's denial of defendant's motion to compel arbitration of plaintiff's claims under the terms of the 2011 trust amendment is affirmed, where: 1) plaintiff was not a signatory to the arbitration agreement; and 2) plaintiff has done nothing to manifest her assent to the terms of the 2011 Trust.
