Gilbert v. Superior Court (People), E059673

In an action to commit petitioner as a sexually violent predator (SVP) pursuant to the Sexually Violent Predators Act (SVPA), the trial court's order denying in part petitioner's motion to quash the People's subpoena duces tecum (SDT) seeking virtually all of petitioner's hospital records, except with respect to documents pertaining to petitioner's trust account and visitor records, is vacated and remanded, where the People are only entitled to documents that may be produced pursuant to section 6603(c)(1), which does not authorize disclosure of therapy records directly to the People but authorizes review of such records by the independent evaluators and grants People access to otherwise confidential treatment information only to the extent it is contained in the updated mental evaluation.
