California Court of Appeal
Gilmore Bank v. AsiaTrust New Zealand Ltd., G048053
In an action to collect a $3.2 million judgment from a judgment debtor, alleging that the judgment debtor and other defendants fraudulently transferred and sequestered the judgment debtor's assets, the trial court's order granting nonresident defendant AsiaTrust's motion to quash service of summons for lack of personal jurisdiction is reversed and remanded where: 1) the California's test for specific jurisdiction in tort cases does not require the defendant to have expressly aimed its intentional conduct at the plaintiff; 2) plaintiffs have met their burden to demonstrate that defendant AsiaTrust's contacts meet the purposeful availment prong of the specific jurisdiction test; 3) a substantial connection exists between plaintiffs' claims and defendant AsiaTrust's forum contacts; and 4) California's exercise of personal jurisdiction over defendant AsiaTrust is fair and reasonable.
