California Court of Appeal

People v. Tessman, D063272

The trial court's order granting defendant five years of formal probation after she was found guilty of one count of residential burglary and one count of commercial burglary is affirmed, where: 1) the residential burglary conviction was proper because the victim's home was an inhabited dwelling house; and 2) the commercial burglary conviction was proper even though the trial court may have relied upon an incorrect legal theory.
