Dismissal of a petition for an order removing certain trustees of defendant retirement fund, the retirement system for the City of San Jose, is affirmed, where the trial court did not err in concluding that: 1) defendant retirement fund is expressly excluded from the definition of a "trust" under Probate section 82; and thus, 2) a petition to remove trustees under the Probate Code may not be maintained against it.
