Branscomb v. JPMorgan Chase Bank, A137140
In a dispute as to the amounts and priorities of deeds of trust the parties hold against real property in San Rafael, the trial court's ruling that plaintiff's deed of trust, which originally was in third position, should be reformed to reflect an indebtedness of $500,000, and is the first-position lien, is reversed and remanded, where the trial court erred in ruling that defendants were not entitled to lien priority under the doctrine of equitable subrogation.
