Mendoza v. Western Medical Center Santa Ana, G047394

Judgment for plaintiff who alleged that he was fired in retaliation for reporting allegations of sexual harassment is reversed and remanded for a new trial, where: 1) the trial court instructed the jury with the 2012 version of CACI No. 2430 regarding causation and a special verdict form consistent therewith; 2) case law issued subsequent to the judgment makes it prejudicial error to do so; but 3) defendants are not entitled to a defense judgment as a matter of law.
