California Court of Appeal

Hui v. Sturbaum, A135597

In an action brought by plaintiff-chiropractor alleging that defendant-insurance claims investigator made false statements to the California Department of Insurance (DOI) and to an assistant to a personal injury attorney, the trial court's grant of defendant's anti-SLAPP motion to strike the complaint is affirmed, where plaintiff has not established a probability of prevailing because the common interest privilege codified in Civil Code Section 47(c) protects defendant's statements to the assistant.
