California Court of Appeal

Whitney v. Montegut, B241755

The trial court properly granted a petition brought by the Executive Director of the Medical Board of California to compel defendant-doctor to comply with investigational subpoenas issued in connection with an investigation of a complaint that defendant may be abusing drugs, prescribing to himself and over-prescribing to patients, where: 1) the petition was timely; 2) the trial court's jurisdictional findings are amply supported by substantial evidence; 3) the Medical Board provided the required notice to patients; and 4) the subpoenas set forth legally adequate cause for enforcement.
