Save the Plastic Bag Coalition v. City and County of San Francisco, A137056
The trial court's denial of plaintiff's challenge to defendant-city's ordinance, which expanded existing restrictions on the use of "checkout bags" by retail establishments in the city is affirmed, where: 1) defendant-city did not err in relying on categorical exemptions in the California Environmental Quality Act (CEQA) rather than preparing an Environmental Impact Report (EIR); and 2) the ordinance is not preempted by the California Retail Food Code.
