V.S. v. M.L., A138827

The trial court erred in dismissing a petition seeking to establish that petitioner is the father of the minor child, where: 1) petitioner has alleged that while he was romantically involved with mother, he impregnated her; 2) one month before the child was born, their relationship terminated and mother married her husband; and 3) under the Family Code as it now reads, petitioner does have standing to bring the petition, and further proceedings are necessary to determine whether petitioner or mother's husband should be adjudicated to be the child's legal father.
