People v. Rios, H038487

Defendant's convictions for carrying a loaded firearm in a vehicle, one count of vehicle theft, and one count of street terrorism, are: 1) reversed in part, as to the street terrorism conviction, where there was no evidence he acted with other gang members; 2) reversed in part as to the gang enhancements, where although the enhancements could apply even if defendant was acting alone, there was insufficient evidence to support the gang enhancements; and 3) reversed in part and remanded, for the trial court to correct the errors in the fines and fees.
