California Court of Appeal

National Financial Lending, LLC v. Superior Court, D064226

In a post judgment proceeding following plaintiff's attempts to collect on a judgment from defendant, and from a third party debtor who owes defendant funds and has continued to pay defendant despite notice of levy, the trial court properly denied the third party debtor's Code of Civil Procedure section 170.6 peremptory challenge, where because the trial judge had previously determined the judgment creditor's liability as a matter of fact and appointed a receiver, no parties, even those joined thereafter, had the right to a section 170.6 challenge.
