Stueve v. Berger Kahn, G046253

In an action alleging that defendant-law firm's attorneys set up a Ponzi scheme to siphon off plaintiffs' assets, the trial court's order granting the Civil Code section 1714.10 motion of defendant-law firm, to strike the conspiracy allegations of the plaintiffs' second amended complaint, is reversed, where the section 1714.10 pre-filing requirement is inapplicable, because none of the claims set forth in plaintiffs' second amended complaint fell within the coverage of the statute, inasmuch as none of them arose from an "attempt to contest or compromise a claim or dispute."
