California Court of Appeal
Kalpoe v. Superior Court, B246154
In an action in which plaintiffs alleged that defendants misrepresented them in an interview regarding the disappearance of Natalee Holloway, plainitiffs' petition for a writ of mandate challenging the trial court's order granting defendant's motion in limine, which barred plaintiffs from introducing any evidence at trial regarding general or punitive damages for defamation, defamation per se, false light, negligent and intentional infliction of emotional distress, is denied, where: 1) Civil Code section 48a, which requires that a plaintiff must demand a correction or is limited only to recovering special damages, clearly applies to all types of television shows; and 2) since plaintiffs did not send a request for a correction, the trial court correctly granted the motion in limine to bar evidence at trial of general or punitive damages.
