The trial court's denial of defendant's motion to strike plaintiff's complaint which alleged that defendant refused to hire him as a weather news anchor because of his gender and age, is reversed and remanded, where: 1) the trial court erred in concluding that plaintiff's claims do not arise from a protected activity; and 2) on remand, the trial court should determine whether plaintiff has demonstrated a reasonable probability of prevailing on the merits of his claims.
