Adams v. MHC Colony Park Limited Partnership, F062160
In an action for nuisance, breach of contract and negligence, against defendant mobile home park owner, alleging that defendant failed to properly maintain the park's physical improvements and common facilities, judgment for defendant against certain plaintiffs is reversed and remanded, where: 1) while erroneous, the jury instruction regarding the elements of a public nuisance was not prejudicial; but 2) the trial court erred by concluding the park's rules and regulations were unambiguous and allowed the park to rent spaces to recreational vehicles.
