Defendant's appeal from misdemeanor convictions for petty theft of personal property, battery, and disturbing the peace, is transferred back to the appellate division of the superior court for disposition, where: 1) the felony count was dismissed before trial and defendant was charged by an amended complaint with only three misdemeanors; and therefore, 2) as a misdemeanor case, appellate jurisdiction over this case is vested in the Santa Clara County Superior Court Appellate Division.
