California Court of Appeal

Benson v. Marin County Assessment Appeals Board, A134340

The trial court's determination that the change from property being held in joint tenancy between two brothers to a tenancy in common was a mere change in the way title is held and not a change in ownership subject reassessment under Proposition 13, is reversed and remanded, where the Legislature determined that a change in ownership occurs when a family joint tenancy is terminated.
