California Court of Appeal

Ventura Kester, LLC v. Folksamerica Reinsurance Company, B241889

Summary judgment for defendant-insurer in an action brought by plaintiff-commercial property owner to recover lost rent when its property was vandalized while vacant, is reversed, where: 1) under the terms of the policy, recovery for lost rent did not require the owner to have an existing tenant; and 2) there are triable issues of fact as to whether the property would have been rented but for the vandalism damage.
