California Court of Appeal
McClintock v. West, G046483
The trial court properly sustained defendant's demurrer to plaintiff's complaint, which alleged damages from defendant's purported misconduct while acting as his guardian ad litem during a divorce proceeding, where: 1) at all times in the underlying case, defendant was acting under the supervision of an experienced family law judge; 2) the trial court properly concluded that the doctrine of quasi-judicial immunity and the litigation privilege, among other things, precluded plaintiff's claims; and 3) there are no allegations of an attorney-client relationship sufficient to hold defendant accountable for legal malpractice.
