California Court of Appeal

Cho v. Chang, B239719

In plaintiff's action alleging sexual harassment and related torts against defendant employer and coworker, the trial court did not err in denying, in part, plaintiff's anti-SLAPP special motion to strike defendant-coworkers' cross-complaint for defamation and intentional infliction of emotional distress, where: 1) each of the causes of action in the cross-complaint combines allegations of conduct that is protected by the anti-SLAPP statute with conduct that is not; and 2) in such a case, the trial court may strike the allegations in the cross-complaint attacking the protected activity while allowing the unprotected theories to remain, which is what the trial court did in this case.
