In an indemnity action against defendant-employer under Labor Code section 2802 for the fees and costs plaintiff-employee incurred in defending himself in a lawsuit brought by a woman who died during a contest put on by defendant, and which plaintiff helped conduct as part of his duties, the trial court did not err in finding that: 1) none of the fees and costs plaintiff incurred after defendant's insurer appointed an attorney to represent him were necessary expenditures; and therefore, 2) plaintiff was not entitled to indemnity for those fees and costs under section 2802.
