Farmers New World Life Insurance Co. v. Rees, B241099

Judgment in an interpleader action awarding deceased wife's husband life insurance policy benefits less attorney fees and costs, after the wife's mother defaulted in the action, is affirmed, where: 1) in this case, the wife's death was investigated as a homicide and the husband was a suspect; 2) the wife's mother would have been entitled to the policy benefits if the husband was found to have feloniously and intentionally killed the wife; 3) under the circumstances of this case, the life insurance company was entitled to file an interpleader action; and 4) the trial court did not err by exercising its discretion to award attorney fees and costs.
