California Court of Appeal

Coffey v. Shiomoto, G047562

Judgment of driving under the influence is affirmed where the evidence of plaintiff's erratic driving, failed field-sobriety tests (FST's), and objective indications of intoxication are substantial evidence that plaintiff had a BAC equal to or greater than 0.08 percent at the time of driving, even though the breathalyzer test results were indicative of a rising blood-alcohol content (BAC).
