People v. Cuevas, A138062

In a consolidated case involving misdemeanor offenses of driving under the influence of alcohol or drugs and driving while having a 0.08 percent or higher blood alcohol level, Veh. Code, section 23152(a) and (b), alleging their blood draws were not performed in a constitutionally reasonable manner, grant of defendants' suppression motions is reversed where the blood draw in each case passed muster under the Fourth Amendment.
