California Court of Appeal

People v. Williams, F062575

Defendant's convictions for violating Penal Code section 386 and related charges are: 1) reversed in part and remanded, where Penal Code section 386 requires proof of the defendant's specific intent to either install a fire protection system which is known to be inoperable or impair the effective operation of a fire protection system, and the word "impair," as used in the statute, means to make worse or diminish in some material respect, and there is a lack of sufficient evidence to support the convictions under section 386, the count of conspiracy, and true finding on the enhancement allegation; but 2) affirmed as to all other counts.
