The trial court's denial of plaintiff's motion for attorney's fees under the Housing Accountability Act, following his successful challenge to defendant's denial of his proposed housing development project, is affirmed, where: 1) the attorney fees provision in Government Code section 65589.5(k) is ambiguous; and 2) based on the legislative history, the attorney fees provision in section 65589.5(k) is interpreted to authorize an award of attorney fees only when "the housing development" in question contains affordable housing.
